Terms & Conditions

Article 1 – Definitions

In these Terms & Conditions, the following definitions shall apply:

• Merchant: Anna Modehaus, established in VIENNA, AUSTRIA.

• Consumer: the natural person who is not acting in the course of a trade, business, craft, or profession.

• Agreement: the distance sales agreement concluded between the merchant and the consumer.

• Products: clothing and related fashion items offered through the webshop.

• Withdrawal Period: the period during which the consumer may exercise their right of withdrawal.

Article 2 – Applicability

  1. These Terms & Conditions apply to every offer made by the merchant and to every distance agreement concluded between the merchant and the consumer.
  2. Before the agreement is concluded, the text of these Terms & Conditions shall be made available to the consumer.
  3. Any deviations from these Terms & Conditions shall only be valid if agreed upon in writing.

Article 3 – The Offer

  1. The offer contains a complete and accurate description of the products offered.
  2. Obvious mistakes or errors in the offer shall not be binding on the merchant.
  3. All images and specifications are indicative and cannot give rise to compensation or termination of the agreement.

Article 4 – The Agreement

  1. The agreement is concluded at the moment the consumer accepts the offer.
  2. The merchant shall confirm receipt of the order by email.
  3. The merchant shall take appropriate technical and organizational measures to secure the electronic transfer of data.

Article 5 – Prices

  1. All prices stated are inclusive of VAT and exclusive of shipping costs, unless otherwise stated.
  2. Any import duties or customs clearance fees shall be borne by the consumer where applicable.
  3. The merchant reserves the right to change prices at any time.

Article 6 – Payment

  1. Payment must be made using the payment methods offered on the webshop.
  2. The consumer is obliged to report any inaccuracies in payment details without delay.
  3. If the consumer fails to meet their payment obligations on time, they shall be considered in default.

Article 7 – Delivery and Fulfilment

  1. The merchant shall process orders with the utmost care.
  2. The place of delivery shall be the address provided by the consumer to the merchant.
  3. We work with international fulfilment partners to deliver our products. As a result, delivery times may be longer than usual.
  4. The average delivery time is 7 to 14 business days, unless stated otherwise.
  5. Exceeding a delivery period shall not entitle the consumer to compensation, unless otherwise required by mandatory law.

Article 8 – Right of Withdrawal

  1. The consumer may cancel an agreement relating to the purchase of a product within a withdrawal period of 14 days without giving any reason.
  2. The withdrawal period starts on the day after the consumer receives the product.
  3. During the withdrawal period, the consumer shall handle the product and its packaging with care.
  4. If the consumer exercises the right of withdrawal, the return shipping costs shall be borne by the consumer.
  5. Refunds will be processed within 14 days after receipt of the returned product or proof of return shipment.

Article 9 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for:

• Products that cannot be returned for hygiene reasons if the seal has been broken.

• Personalized or custom-made products.

Article 10 – Conformity and Warranty

  1. The merchant guarantees that the products conform to the agreement, the stated specifications, and reasonable standards of quality and usability.
  2. Any defects must be reported in writing within a reasonable period after discovery.

Article 11 – Complaints Procedure

  1. Complaints regarding the performance of the agreement must be submitted fully and clearly described.
  2. The merchant shall respond to complaints within 14 days of receipt.
  3. Consumers may also submit a complaint via the European ODR platform:

Article 12 – Liability

  1. The merchant's liability is limited to the amount of the order.
  2. The merchant shall not be liable for indirect damages, unless caused by intent or gross negligence.

Article 13 – Force Majeure

  1. The merchant shall not be obliged to fulfill any obligation if prevented from doing so due to force majeure, including delays by suppliers, logistical issues, or international shipping disruptions.

Article 14 – Intellectual Property

  1. All intellectual property rights relating to the website, texts, images, and other content are owned by the merchant or its licensors.

Article 15 – Governing Law and Disputes

  1. All agreements shall be exclusively governed by Dutch law.
  2. Any disputes shall be submitted to the competent court in the Netherlands.
